Terms of Service

1. Acceptance of Terms

By installing or using Vision Guardian, you agree to be bound by these terms. If you do not agree, do not use the app.

2. Description of Service

Vision Guardian is an iOS application that connects to your Ring camera account and uses AI to analyze motion-triggered snapshots across 10 detection types (people count, garage door, garbage truck, vehicle, package delivery, animal, lights on unoccupied, weather hazard, unauthorized party, and security alert). The service sends push notifications based on your configured preferences and includes an AI Camera Chat feature that lets you ask questions about your recorded detection events.

3. Ring Account

You must have a valid Ring account to use Vision Guardian. You are responsible for maintaining the security of your Ring credentials. Vision Guardian accesses your Ring cameras only through Ring's official OAuth API and only with your explicit authorization.

4. Acceptable Use

You agree not to:

• Use Vision Guardian to monitor individuals without their knowledge or consent.
• Attempt to reverse engineer, hack, or circumvent the service.
• Use the service for any unlawful purpose.

5. AI Analysis Accuracy

Vision Guardian uses AI for detection, which may not be 100% accurate. We do not guarantee that all detections will be correct or that all events will be captured. Do not rely on Vision Guardian as your sole security solution.

6. Fair Use Limits

To ensure consistent service quality, Vision Guardian enforces the following daily limits (all reset at midnight your local time):

• AI Motion Analysis: 200 events per camera per day. Events beyond this limit will not be analyzed and will not trigger notifications.
• AI Camera Chat: 30 messages per user per day. The chat assistant answers based solely on recorded detection events from the last 30 days and cannot access live camera feeds or analyze images in real time. Messages that exceed the daily limit receive an error response; the limit resets automatically at midnight your local time.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability.

8. Limitation of Liability

Vision Guardian is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any damages arising from your use of the service, including missed detections or false alerts.

9. Indemnification

You agree to indemnify, defend, and hold harmless Vision Guardian and its developers from and against any and all third-party claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your content, your Ring account or camera footage, or your use of the app in violation of these Terms. This obligation does not apply to claims arising solely from Vision Guardian's own negligence or misconduct.

If a claim subject to this section arises, you agree to notify us promptly in writing at legal@kukenan.io. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim. You may not settle any such claim in a way that admits fault by, or imposes any obligation on, Vision Guardian without our prior written consent.

10. Arbitration & Class Action Waiver

This section is governed by the Federal Arbitration Act (FAA). Before filing any arbitration claim, you must first send a written Notice of Dispute to legal@kukenan.io describing the nature of your claim and the relief sought. Upon receipt, both parties agree to negotiate in good faith for 60 days to try to resolve the dispute before arbitration may be initiated.

If the dispute is not resolved within that 60-day period, you and Vision Guardian agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the app shall be resolved exclusively by final and binding arbitration, rather than in court. Arbitration is conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitrator, and not any court, shall have exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this arbitration agreement.

• Each party shall bear their own arbitration costs unless the arbitrator rules otherwise, or unless AAA Consumer Rules assign filing fees to Vision Guardian.
• Arbitration takes place in the county where you reside or via videoconference.
• The arbitrator's decision is final and binding on both parties.
• You waive the right to a trial by jury with respect to any claim covered by this section.

Your Right to Opt Out: You may opt out of this arbitration agreement by sending written notice to legal@kukenan.io within 30 days of first accepting these Terms (or, for existing users, within 30 days of the effective date of this revised section). Your notice must include your name, the email address on your account, and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor Vision Guardian will be required to arbitrate, but the Class Action Waiver below still applies to the fullest extent permitted by law. Opting out does not affect any other part of these Terms.

Class Action Waiver: You and Vision Guardian agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding. If this Class Action Waiver is found to be unenforceable as to a particular claim or dispute, then this entire arbitration agreement (except for this sentence) shall not apply to that claim or dispute, and it must be brought in a court of competent jurisdiction on an individual basis only — not as a class, collective, or representative arbitration.

Mass Filings: If 25 or more similar arbitration claims are filed by or with the assistance of the same law firm or organization within a 60-day period ("Mass Filing"), the claims will be administered in batches of 25 as agreed by the parties or ordered by the administrator, proceeding one batch at a time, with fees assessed only as each batch is filed, in accordance with the AAA's mass arbitration procedures (or those of a mutually agreed alternative arbitration provider equipped to handle Mass Filings). The parties agree to cooperate in good faith to implement this batching process.

Nothing in this section waives any non-waivable representative claim (such as a representative action under the California Private Attorneys General Act) to the extent such a claim cannot lawfully be subject to a pre-dispute arbitration or class-waiver agreement; any such claim shall proceed in court on a representative basis only after the individual portion of the claim has been resolved as required by this section.

Exception: either party may bring an individual claim in small claims court if it qualifies. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for intellectual property infringement or unauthorized access to the app.

11. Termination

You may stop using Vision Guardian at any time by disconnecting your Ring account and deleting the app. We reserve the right to suspend or terminate accounts that violate these terms.

12. Changes to Terms

We may update these terms at any time. Continued use of the app after changes constitutes acceptance of the new terms. Material changes to the dispute resolution and arbitration terms (§10) will not bind existing users via continued use alone — those users are re-prompted to accept the revised terms in the app.

13. Governing Law

These terms are governed by the laws of the United States, without regard to conflict of law principles, except where the Federal Arbitration Act governs dispute resolution as set out in §10.
